Terms of Sale

Effective September 29, 2026 · Version 2026-09-v1

The conditions that apply when you buy equipment or services from Prime Power Fitness: quotes, orders, prices, taxes, payment, delivery, warranty, returns and liability.

On this page (20)

These Terms of Sale govern every purchase of equipment and services from Prime Power Fitness, whether you order online through our checkout or accept a quote prepared by our sales team. Please read them before placing an order. They are written in plain language, and nothing in them limits the rights that consumer-protection laws give you where you live.

1. Who we are

These terms are offered by Prime Power Fitness, a seller of commercial-grade strength equipment based at 7250 Keele St, Unit 223, Concord, Ontario L4K 1Z8, Canada ("Prime Power Fitness", "we", "us"). You can reach us by email at contact@primepower-fitness.com or through our contact page. Our website is www.primepower-fitness.com.

2. Scope and acceptance

These terms apply to sales to consumers and to business customers in Canada, the United States and the Gulf countries we serve (United Arab Emirates, Saudi Arabia, Qatar, Kuwait, Bahrain and Oman). By placing an order or accepting a quote, you confirm that you have read and accepted them. Specific conditions written in a quote you accept (price, freight, lead time, delivery conditions, payment terms) prevail over these general terms for that order, except where mandatory law provides otherwise.

Use of the website itself is governed by our Terms of Service, and your personal information is handled as described in our Privacy Policy.

3. Products

We sell commercial-grade strength equipment: selectorized machines, plate-loaded machines, multi-stations and functional trainers, benches, racks, storage, Smith machines and accessories. Most items are heavy and ship by freight.

We describe our products as accurately as possible. Photos, 3D views and renderings are illustrative; colours, finishes and minor details may vary. We may improve specifications without notice where this does not reduce a product's function, safety or quality. If a detail matters to your project (dimensions, footprint, weight stack, finish), ask us to confirm it in writing before you order.

4. Quotes

Many products are sold on a "price on request" basis. You can request a quote through our quote page or the "Request a quote" buttons on product pages. A quote sets out the products, prices, currency, freight, the taxes and duties known at the time, and the estimated lead time.

Unless the quote states otherwise, a quote is valid for 30 days from its date. After that period, prices, freight and availability may be updated. A quote becomes a binding order only once you accept it in writing and, where the quote requires it, pay the amount requested.

5. Placing an order online

Some products can be ordered directly through our online checkout. To place an order, you provide your name, email address, phone number (needed to coordinate freight delivery), company name (optional), delivery address, country, province, state or region, postal code, and the shipping method you choose. Please check this information carefully: an incorrect address or contact detail may delay delivery or lead to additional carrier charges.

When you submit the checkout, your order is recorded with the status "pending payment". Submitting an order is an offer to buy; it is not yet accepted. If freight cannot be priced automatically (for example for Gulf destinations or oversized orders), your order becomes a quote request and we send you a freight quote before any payment is taken.

We may decline or cancel an order before it is confirmed, for example if a product is unavailable, if a price or description is obviously wrong, if we cannot deliver to the address provided, or if we suspect fraud. In that case we inform you promptly and refund in full any amount already paid.

6. Order confirmation

Your order is confirmed once we receive your payment or, for business customers buying on a quote, once you accept the quote in writing on the payment terms it states. We then send you a confirmation by email, and the contract of sale is formed at that time. Keep your order number: you will need it for delivery, return and warranty requests.

7. Prices and currencies

Our prices are set in Canadian dollars (CAD). The currency displayed follows the delivery country: Canadian dollars, US dollars (USD), UAE dirhams (AED) or Saudi riyals (SAR), depending on the destination. Prices converted from CAD are indicative until your order or quote is confirmed; the amount that applies is the one shown on your order confirmation or accepted quote.

Unless stated otherwise, prices do not include freight, optional services (inside delivery, installation), taxes, customs duties or brokerage fees, which are shown separately at checkout or on the quote. We may change our prices at any time, but a change does not affect an order already confirmed or a quote that is still valid.

8. Taxes, duties and customs

Canada

GST/HST and, depending on the delivery province, QST or PST are calculated at checkout on the goods and on freight, and appear on your invoice.

United States

We collect sales tax only in states where we are registered or required to do so. Otherwise, you are responsible for any use tax due in your state. Import duties, customs fees and brokerage charges are payable by you unless your quote states otherwise.

Gulf countries

Deliveries are generally made DAP (delivered at place, duties unpaid). Import VAT (for example 5% in the United Arab Emirates and 15% in Saudi Arabia), customs duties and clearance charges are payable by you on import unless your quote states otherwise.

For every delivery outside Canada, we provide the documents needed for customs clearance. You are responsible for any import formalities that the law of the destination country places on the importer.

9. Payment

Depending on the order, payment is made in one of two ways:

  • Online by card through Stripe, when online payment is offered at checkout. Depending on your country and the order amount, Stripe may also offer Apple Pay, Google Pay or pay-later options such as Affirm or Klarna; these options are subject to their providers' own terms.
  • By invoice: our sales team contacts you with an invoice and payment instructions.

Card payments are processed by Stripe. We never see or store your full card number; we only receive the payment status and limited details such as the card brand and the last four digits. Payment must be received in full before shipment, unless your accepted quote provides other payment terms. If payment is not received within the time stated on the invoice or quote, we may cancel the order.

10. Delivery, title and risk

Heavy items ship by LTL freight carrier; small items may ship by parcel. Estimated lead times are shown at checkout or on your quote. They are estimates, not guaranteed dates, and we keep you informed of any significant delay. Any right the law gives you to cancel an order for late delivery is not affected.

Standard delivery is curbside or to the loading dock (ground floor, no inside delivery, no assembly), unless inside delivery or installation has been ordered and quoted. You must make sure the site is accessible: vehicle access for a freight truck, doorways, stairs, elevators, floor load capacity, and a person present to receive the goods. If a delivery fails because of access problems or because no one is present, redelivery and storage fees charged by the carrier are payable by you.

Title and risk of loss pass to you on delivery. Full details are in our Shipping & Freight Policy.

11. Inspection on delivery

  1. Inspect the shipment before signing the delivery receipt (bill of lading): count the boxes and look for visible damage.
  2. Write any visible damage or missing boxes on the delivery receipt before signing it, and take photos.
  3. Notify us within 48 hours of delivery. For concealed damage discovered when unpacking, notify us within 7 days of delivery.

We then handle the claim with the carrier and repair or replace the affected items. These deadlines allow us to file a claim with the carrier; they do not remove any right you have under applicable law.

12. Installation and assembly services

Installation is an optional service, quoted separately. Depending on the quote, it may include floor planning, delivery inside the premises, assembly, levelling and removal of packaging. The scope, price and schedule are those stated on the quote. You must provide safe access to the room, a floor suitable for the weight of the equipment, and any authorization required by your building. Defects caused by assembly or installation carried out by anyone other than us or our installer are not covered by the warranty (see section 13).

13. Warranty

We warrant our equipment against defects in materials and workmanship under normal use, for commercial and residential use. The warranty runs from the date of delivery, benefits the original purchaser and covers the following periods:

  • Structural frame and welds: lifetime (for the original purchaser, for as long as they own the equipment).
  • Moving parts: 3 years (pulleys, cables, bearings, guide rods, bushings, pins, springs and weight-stack components).
  • Upholstery, grips, pads and cosmetic finishes: 1 year.

What the warranty does not cover

  • normal wear and tear, including wear of cables and upholstery;
  • misuse, or loads beyond the equipment's specifications;
  • improper assembly or installation not carried out by us or our installer;
  • lack of routine maintenance, such as cleaning, lubrication and cable inspection;
  • outdoor use or use in a corrosive environment;
  • modifications made to the equipment;
  • accidents;
  • cosmetic damage that does not affect how the equipment works.

What we do

If a covered defect is confirmed, we repair or replace the defective part and ship the replacement part to you. Labour is not included, unless the equipment was installed by us and the claim is made within the first year after delivery.

How to make a warranty claim

Email contact@primepower-fitness.com with your order number, photos or a video showing the problem, and a description of the defect. We may ask for additional information or for the defective part to be returned. Stop using any equipment that appears unsafe until it has been inspected or repaired.

This warranty is in addition to the legal warranties provided by the law of your place of residence. In Québec, for example, the Consumer Protection Act and the Civil Code of Québec provide a legal warranty that goods are fit for the purpose for which they are ordinarily used and remain durable in normal use for a reasonable time. Nothing in this section limits those rights.

14. Returns, refunds and cancellations

You may return eligible products within 30 days of delivery under the conditions of our Returns & Refunds Policy, which include a prior return authorization (RMA), return freight at your expense and a 15% restocking fee on accepted returns. Damaged, defective or incorrect items are not subject to the fee or to return freight. An order can be cancelled free of charge before shipment; after shipment, it is treated as a return.

15. Limitation of liability

To the extent permitted by applicable law:

  • our total liability relating to an order is limited to the price paid for the products or services concerned;
  • we are not liable for indirect or consequential losses, such as loss of profit, loss of revenue, business interruption or loss of use of premises;
  • we are not liable for damage resulting from use of the equipment contrary to its instructions, specifications or safety warnings, or from a cause excluded under section 13.

Nothing in these terms excludes or limits our liability for death or personal injury, for gross negligence or intentional fault, for fraud, or any other liability that cannot be excluded or limited by law. If you are a consumer, these limitations do not affect the rights given to you by the consumer-protection laws of your place of residence, including the Québec Consumer Protection Act; where those laws do not allow a limitation, it does not apply to you.

16. Force majeure

We are not responsible for a delay or failure to perform caused by events beyond our reasonable control, such as natural disasters, fire, flood, epidemics, war, civil unrest, government decisions, strikes, port or border closures, carrier disruptions or supplier shortages. We inform you promptly and perform as soon as reasonably possible. If the event continues for an unreasonable period, either of us may cancel the affected part of the order, and we refund any amount paid for products or services not delivered.

17. Business customers

Gyms, studios, hotels, schools and other businesses can request a Pro account and volume pricing through our Pro page; pricing is confirmed on quotes. For customers buying for the purposes of their business rather than as consumers:

  • the order is confirmed on written acceptance of the quote, on the payment terms it states;
  • rules reserved by law for consumers do not apply, and the limitation of liability in section 15 applies to the fullest extent permitted by law;
  • you are responsible for checking that the equipment, its installation and its use comply with the rules that apply to your premises and activity (for example building, fire-safety and workplace-safety rules);
  • the conditions of an accepted quote, and of any written agreement signed by both parties, prevail over these general terms.

18. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, and the courts of Ontario have jurisdiction. If you are a consumer, this choice of law and courts does not deprive you of the protection of the mandatory consumer-protection rules of your place of residence (including the Québec Consumer Protection Act and the laws of other Canadian provinces, US states or Gulf countries), nor of any right those rules give you to bring proceedings before the courts they designate. Before starting any proceedings, please contact us: most issues can be resolved quickly by email.

19. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one published on the date of your order or of your acceptance of the quote. The date at the top of this page shows the latest update.

20. Contact

For any question about these terms, an order, a delivery, a return or a warranty claim, email contact@primepower-fitness.com or use our contact page. Please include your order or quote number.
